At SunxAI, we are committed to providing you with the best experience and ensuring you enjoy our services. To do so, we need to understand your creation habits so we can provide excellent personalized services. Your privacy and the security of your personal data are vital to us and always will be. Therefore, we want to explain transparently how and why we collect, store, share, and use your personal data, and outline the control and choices you have regarding if, when, and how you share your personal data.
That is our goal. This Privacy Policy (the “Policy”) explains what we mean in detail below.
2. About This Policy
Section titled “2. About This Policy”This Policy describes the essential details of the personal data relationship between you and Sunx AI, Inc. This Policy applies to all SunxAI services and any related services (collectively, the “SunxAI Services”). The terms for using the SunxAI Services are described in our “Terms and Conditions”.
From time to time, we may develop new services or offer additional services. If launching those services results in any material changes to how we collect or process your personal data, we will provide more information and/or additional terms or policies. Unless otherwise stated, those new or additional services will be subject to this Policy.
The purposes of this Policy are:
- to help ensure you understand what personal data we collect about you, why we collect and use it, and with whom we share it;
- to explain how we use the personal data you share with us to provide you with a great experience when you use the SunxAI Services;
- to explain the rights and choices you have regarding the collection and processing of personal data, and how we protect your privacy.
We hope this helps you understand our privacy commitments. To learn more about terms used in this Policy, please visit our Help Center. Also, if you do not agree with the contents of this Policy, please remember that whether you use the SunxAI Services is entirely up to you.
3. Your Rights and Preferences: Giving You Choice and Control
Section titled “3. Your Rights and Preferences: Giving You Choice and Control”The General Data Protection Regulation (“GDPR”) grants individuals certain rights regarding their personal data. We are happy to provide transparency and access controls to help users exercise these rights. To the extent permitted by applicable law, individuals may have the following rights:
- Right of access — you have the right to know and request access to the personal data we process about you;
- Right to rectification — you have the right to request that we modify or update personal data that is inaccurate or incomplete;
- Right to erasure — you have the right to request that we delete your personal data;
- Right to restriction of processing — you have the right to request that we temporarily or permanently stop processing all or part of your personal data;
- Right to object — you have the right to object at any time, on grounds relating to your particular situation, to our processing of your personal data; you have the right to object to the use of your personal data for direct marketing;
- Right to data portability — you have the right to request a copy of your personal data in electronic format and to transmit that personal data to another party for use in their service;
- Right not to be subject to automated decision-making — you have the right not to be subject to a decision based solely on automated decision-making (including profiling) where that decision produces legal effects concerning you or similarly significantly affects you.
To help you better understand and more easily exercise these rights, and to record your preferences regarding how SunxAI uses your personal data, we provide the following resources:
- Control Panel (accessible via your account page) — allows you to choose certain processing of personal data, and provides features such as automated download and file exclusion.
- Notification Settings (accessible via your account page) — allows you to choose whether to receive marketing messages from SunxAI. You can toggle these settings to opt in or out of different categories of email and push notifications. Please note that SunxAI’s marketing emails also include an unsubscribe mechanism (for example, an unsubscribe link in the email). You can use the “Notification Settings” page to manage preferences across all categories of email and push marketing messages.
- Cookie Policy — provides more information about how we use cookies, including for interest-based advertising. You can also find information on how to manage your cookie preferences and opt out of certain types of tracking (see the “Cookies and Tracking Technologies” section of this Policy).
- Customer Support Resources — our customer support site includes multiple pages with additional guidance on data protection topics.
If you have questions about privacy, your rights, or how to exercise these rights, please use the “Contact Us” form on the website to contact our privacy officer (if applicable). If you have concerns about how we process your personal data, we hope you will continue working with us to resolve them. Of course, you may also contact your local data protection authority and have the right to lodge a complaint.
4. Personal Data We Collect From You

The table below describes the personal data collected when you register for the SunxAI Services:

Certain technical data may also be included, such as: URL information; online identifiers including cookie data and IP address; information about the type of device you are using, such as a unique device ID, network connection type (e.g., Wi‑Fi, 3G, LTE, Bluetooth), provider, network and device performance, browser type, language, enabled digital rights management information, operating system, and SunxAI application version; device attributes of devices on your Wi‑Fi network that can connect to the SunxAI Services (e.g., speakers); and your non-precise location data (which may be derived or inferred from certain technical data, such as your IP address, the language settings of your device, or payment currency), in order to comply with geographic requirements in our license agreements and to provide you with personalized content and advertising. |

We collect your personal data from various third parties. These third-party sources may change over time and include:

5. How We Use Your Personal Data

6. Sharing Your Personal Data

6.1 Public information
Section titled “6.1 Public information”The following personal data will always be public on the SunxAI Services: your name and/or username, and profile picture.
6.2 Personal data you can choose to share
Section titled “6.2 Personal data you can choose to share”The following personal data will be shared only with the categories of recipients listed in the table below when:
- you choose to use a specific feature within the SunxAI Services that requires sharing specific personal data to function; or
- you grant us permission to share personal data, for example by selecting appropriate settings within the SunxAI Services or through provided consent mechanisms.

6.3 Information we may share

7. Data Retention and Deletion
Section titled “7. Data Retention and Deletion”We retain your personal data only for as long as necessary to provide you with the SunxAI Services and for legitimate and essential business purposes (such as maintaining the performance of the SunxAI Services, making data-driven decisions about new features and products/services, meeting our legal obligations, and resolving disputes). We will retain some of your personal data as long as you are a user of the SunxAI Services. For example, we retain your media files, processed files, and account information.
If you request it, we will delete or anonymize your personal data so that it can no longer identify you, unless we are legally permitted or required to retain certain personal data, including in the following circumstances:
- If your account has unresolved issues (for example, outstanding payments, claims, or disputes), we will retain the necessary personal data until those issues are resolved;
- Where we need to retain personal data to comply with legal, tax, audit, and accounting obligations, we will retain the necessary personal data for the period required by applicable law; and/or
- Where necessary for our legitimate business interests, such as preventing fraud or maintaining the safety of our users.
To request deletion of your account, you can find an entry such as “Delete account / Close account” in your account settings and follow the prompts. If you cannot access that entry, please contact us by email at support@sunx.ai.
8. Transfers to Other Countries
Section titled “8. Transfers to Other Countries”To carry out the activities described in this Policy, SunxAI shares your personal data globally with companies in the SunxAI group. SunxAI may also outsource processing of your personal data to third parties located outside your country/region, or share your personal data with third parties located outside your country/region. As a result, your personal data may be subject to privacy laws different from those in your country/region.
For example, personal data collected within the EU and Switzerland may be transferred to and processed by third parties located in countries outside the EU and Switzerland. In such cases, SunxAI will ensure that transfers of your personal data comply with applicable privacy laws, and in particular will ensure appropriate contractual, technical, and organizational safeguards are in place, such as the European Commission’s approved Standard Contractual Clauses.
9. Links
Section titled “9. Links”We may display advertisements from third parties and other linked content to third-party websites. We do not control third parties’ privacy practices or content and do not accept responsibility for them. If you click on third-party advertisements or links, please note that you will leave the SunxAI Services and any personal data you provide will no longer be protected by this Policy. Please read their privacy policies to understand how they collect and process your personal data.
10. Protecting Your Personal Data
Section titled “10. Protecting Your Personal Data”We are committed to protecting users’ personal data. We implement appropriate technical and organizational measures to help protect the security of your personal data. However, please note that no system is completely secure. We have implemented various policies, including anonymization, encryption, access controls, and data retention policies, to prevent unauthorized access and unnecessary retention of personal data.
Your password helps protect your user account, so we encourage you to use a strong password that you use only for your SunxAI account, never share your password with anyone, limit access to your computer and browser, and log out after using the SunxAI Services.
11. Children
Section titled “11. Children”The SunxAI Services are not directed to individuals under 13 years of age. In addition, where processing children’s personal data would be unlawful under the GDPR or other local laws, or where parental consent is required to process a child’s personal data, the SunxAI Services are also not offered to those children.
We do not knowingly collect personal data from individuals under 13 years of age or below the applicable age of consent (the “Age Limit”). If you are below the Age Limit, please do not use the SunxAI Services and do not provide us with any personal data.
If you are a parent of a child below the Age Limit and become aware that your child has provided personal data to SunxAI, please contact us.
If we discover that we have collected personal data from someone under the age of 13, we will take reasonable steps to delete that personal data. This may require us to delete the person’s SunxAI account.
12. Changes to This Policy
Section titled “12. Changes to This Policy”We may update this Policy from time to time.
When we make material changes to this Policy, we will notify you in a prominent way as appropriate, for example by displaying a prominent notice within the SunxAI Services, or by sending you an email and/or device notification. We may provide advance notice.
